The Constitutional Court (VfGH) has rejected the request of ex-minister of finance Karl-Heinz Grasser in connection with his conviction at first instance in the Buwog trial. That was announced Thursday morning.
In connection with the Buwog trial, Grasser filed a motion to repeal provisions of the Code of Criminal Procedure (StPO) as unconstitutional. For example, Grasser objects to the fact that the judge itself must decide on the rejection of a judge for bias, which is made during the main hearing, without a separate appeal against it. The argument goes that this violates the right to a fair trial or the right to an effective complaint.
