From January, the self-employed can combine the collection of unemployment benefits with the development of the activity, something that is currently prohibited. This is one of the novelties that includes the new premium system for the self-employed that was approved by the Council of Ministers this Tuesday, whereby almost half of the entrepreneurs pay less fees than now, 25% remain as it is and 25% remain (about 750,000 employees). ) will have higher contributions.

The new law, which fixes a minimum compensation for 2023 between 230 and 500 euros per month, depending on the net income obtained, improves and extends the benefits of the group so that for the first time in history (excluding the pandemic period) do not have to lower their company’s blinds or opt out of the RETA to receive this assistance.

“The benefit for the cessation of activity did not meet its objectives, neither quantitatively nor qualitatively”, acknowledged the Minister of Social Security, José Luis Escrivá, pointing out a very important fact: in 2019, fewer than 1,500 self-employed persons had access to this advantage. For this reason, the government has carried out a complete reformulation of the protection of the self-employed, maintaining the normal cessation of activity, but introducing new modalities. Thus, a new benefit is recognized of 50% of the legal basis compatible with another activity, which can be collected for a period of four months to two years. To gain entry, they must prove a 75% reduction in income or sales when there are no employees, and those who have employees, the same reduction in billing, have an income below the minimum wage, and 60% of the employees in a ERTE.

The partial temporary cessation due to force majeure is also arranged when there is an emergency declaration and the self-employed lose 75% of their income and are left with an income that does not exceed the SMI.

In addition, the protection of the RED mechanism has been adapted to the self-employed, so that they can use it in the same way as salaried employees. So there will be a cyclical RED for when an unfavorable general macro-economic situation breaks out and, if activated by the Council of Ministers, the self-employed who meet the requirements can collect 50% of the regulatory base for one year and enjoy a 50% discount on the costs And then there is the sectoral RED for when lasting change is valued in a sector in need of retraining and professional transition processes. In this case, the beneficiaries will receive a one-off payment of 70% of the legal basis and a payment of 50% of the contribution.
