The CGPJ appoints Rafael Mozo as interim president, causing bicephaly in the judiciary

The CGPJ has agreed to appoint its oldest member, Raphael Youngas interim president, after the resignation of Carlos Lesmesmeaning ‘de facto’ that the leadership of the judiciary is divided, as the magistrate Francisco Marin Castan is the one who has held the functions of the presidency of the Supreme Court (TS) since the Lesmes’ resignation became effective.

The vote went ahead with a large majority, 16 votes in favor and only one against — that of the Member Wenceslas Olea–, while the vowel Sea Cabrejas has been absent.

Mozo, who came to the CGPJ at the suggestion of the PSOE, entered the legal career in 1985. He had several destinations until he ended up before the Provincial Court of Madrid in 1998. Since 2018, he has held his seat as magistrate of the Criminal Chamber of the National Court.

Convened by Lesmes himself for the purpose of the progressive and conservative sectors of the General Council of the Judiciary to report on the state of negotiations to appoint the two candidates to the Constitutional Court (TC) after their third failed meeting, the truth is that this Thursday’s plenary was devoted to the issue of succession.

Sources from the CGPJ and TS warn that this bicephaly could lead to a legal conflict that would be settled in the Controversial Administrative Chamber of the Supreme Court, specifically in Section Six, which deals with the appeals filed against the CGPJ- agreements.
