“We need to modernize crimes against public order, they are obsolete”

The member of the secretary of the association of progressive judges and magistrate of the Provincial Court of Bizkaia explains that, unlike European democracies, the Spanish state maintained “the nineteenth-century regulation” of these crimes.

The member of the secretariat of Judges and Judges for Democracy and magistrate of the Provincial Court of Bizkaia, Edmundo Rodríguez Achútegui, believes that the government’s proposal to reform the current crime of sedition “is a consequence of the need to modernize crimes against public order, whose regulations go back to the 19th century and is completely outdated“.

For Rodríguez Achútegui, in the second half of the 20th century, modern European democracies updated “the 19th-century regulation of these crimes”, something that did not happen in Spain “because the Franco regime maintained 19th-century provisions that were inconsistent with the standards required by international treaties” it has signed since the transition.

The magistrate explained in statements to Europa Press that the current settlement in these cases “is not comparable to that of the rest of the European countries“, and this is evidenced by “the great difficulties encountered by the German or Belgian courts in meeting the demands of the Supreme Court to arrest Puigdemont”.

In addition, he has stated that although the problem is: under the judge (subject to trial) in the Court of Justice of the European Union, “it is necessary to update a group of crimes that have outdated regulations and do not correspond to the current parameters of guarantees of our rule of law”.
