The coroner recommended against the imprisonment of the former president of Andalusia because of his prostate cancer. José Antonio Griñán was sentenced to six years in prison in the so-called ERE case.

The Anti-Corruption Prosecutor’s Office has requested the necessary measures that will allow the Institute of Legal Medicine (IML) of Seville to evacuate or not from the “a more accurate report on the origin” admission to prison of the former socialist president of the Junta de Andalucía José Antonio Griñán, sentenced to six years and one day in prison for the case of the EREs, a fraudulent social and labor aid system that was deployed between 2000 and 2011.
The defense of the former president of the Junta de Andalucía asked the Seville court – which gave him until January 1 for his voluntary imprisonment – to suspend the claim of an alleged serious illness.
In their briefing, the Delegated Prosecutors in Seville of the Special Prosecutor’s Office against Corruption point out that “given the report of the Institute of Legal Medicine of Seville dated January 3, 2023, according to which, taking into account the proximity of the diagnosis of Mr. Griñán and the fact that treatment has not started, the forensic doctor concludes, given the need to make a “predictive analysis” of the evolution of the disease’the undesirability of their admission to the Penitentiary Center until the remission is confirmed, where appropriate, of his Oncological Pathology by the Department of Urology and Radiology Oncology”.
The Institute of Legal Medicine of Seville argues that entering prison “does not help to face a disease of this entity, which requires all available resources that the person has at his disposal”, such as “family support and necessary and even essential in these cases”.
The first section of the hearing last December rejected the defense appeal of the former Andalusian politician to prevent him from going to jail and gave 10 days to go to jail. Decision that the hearing be extended to another six convicts.
The defense of the also convicted former Deputy Minister of Employment Agustín Barberá led the judges to temporarily suspend the execution of his prison sentence by using similar arguments.
That has been precisely the line taken by the former socialist leader’s lawyers, who have claimed he suffers from “a very serious disease with incurable conditions” and that he will not be able to receive the treatment he needs when he is taken to prison. That is why the court of Seville has decided to suspend registration for the time being.
