The Public Prosecution Service agrees to maintain the embezzlement sentences for those convicted of the trial

The Attorney General’s Office argues that the penal code reform, which turns the crime of sedition into aggravated public disorder and reduced that of embezzlement, allows the sentences imposed by the Supreme Court on the former vice president of the maintain generality oriol junqueras and former ministers Jordi Turull, Raul Romeva and Dolors Bassa, and has asked for his 13-year disqualification sentences to be left intact. On the contrary, it supports lowering sentences for people convicted only of sedition: Carme Forcadell, Jordi Sànchez, Jordi Cuixart, Joaquin Forn and Josep Rull.

The Attorney General, Álvaro García Ortiz, has a decision to establish criteria in the assessments of cases made because of the criminal justice reform that has changed embezzlement. It has agreed to uphold the sentences handed down under Article 432 of the Penal Code which was in effect in 2015, because said reform “established identical prison sentences and disqualification”, including the punishment of the ‘trial’.

The prosecution explains that “the profit motive required by the new crime of embezzlement will be valued in all cases where the responsible person acts conscientiously and has the will to dispose of public assets as if they were his own, and uses them for purposes that not connected with the public’s function to obtain a benefit or advantage of their own or that of another of any kind”.

“Consequently, the profit motive will also be valued when the person responsible for the crime is not seeking to obtain a patrimonial advantage or a personal economic advantage,” he stressed.

On the other hand, the Public Prosecution Service does support it reduce the sentences of those convicted only of sedition. That is why he is asking the Supreme Court to reduce the sentences of disqualification of the former Speaker of Parliament Carmen Forcadell (9 years and two months), to Jordan Sanchez Y Jordan Cuixart (5 years for public disorder) and ex-consellers Joaquin Forn Y Joseph Roll (8 years and 2 months).

All convicts were pardoned, although the penalties of disqualification continue to weigh on them.
