The judge of the National Court, José Luis Calama, has stated: secret investigation about the infection with the Pegasus spy software of the cell phones of the president of the government, Pedro Sanchezand the Minister of Defence, Margaret Oaksto avoid “interference” that could hinder it.
He also offered to appear as an injured party in the case, as the Public Prosecution Service had requested in its official report.
With the aim of “avoid a situation that could be endangered seriously the result of the investigation”, the head of the central court of instruction number 4 has agreed to the secrecy of the procedure for a period of one month at the request of the Public Prosecution Service.
The order explains that this is the only way to “prevent knowledge of the results of the proceedings” from giving rise to “interference or manipulation to hinder the investigation and frustrate its objectives”.
To agree on secrecy, the judge took into account “the possible existence of sensitive information that could be legally classified, seriously endanger the security of the state or harm the legitimate interests of persons outside the proceedings”.
However, the magistrate states that the results of the investigation will be announced later and that in this way “any reduction of the rights of defence” is avoided.
The procedure was opened in response to the complaint submitted by the Board last Monday. At present, according to two reports from the National Cryptologic Center, it is known that in the case of the president, the cell phone infection occurred on May 19 and 31, 2021; and in the month of June in the case of Robles, and that currently none of the cellphones analyzed show “indicators of ongoing Pegasus infection”.
