Sumar has loaned two deputies to the ERC and the PSOE four to Junts. Loaning deputies is a common practice, although it requires board approval. After assembling the eight groups, the Chamber will be able to organize the chamber and resolve previous issues to start the legislature.
The Congressional Council will give free reign to the parliamentary groups of Esquerra Republicana (ERC) and Juntswith which you are registered delegates loaned by Sumar and the PSOErespectively by not complying with the requirements of the Regulation.
Borrow deputies or senators that the political forces get their own group in the Congress or the Senate, as the PSOE and Sumar will do with JxCat and ERC, is a usual practiceThat requires the approval of the board of the Chamber To thrive. The Congressional table, which meets Monday afternoon, will predictably support the transfer of delegates as the borrowing parties, the PSOE and Sumar, hold majorities in the House’s governing body.
In Congress, the ordinance allows parties with more than 15 seats or those, with a minimum of 5, more than 5% of the vote in all of Spain or 15% in the constituencies in which they agree, to form a group. In this new parliamentary term, PP, PSOE, Vox and Sumar fulfill the first requirement EH Bildu And PNV, the second.
However, neither the ERC nor the Junts strictly adhere to these requirements because, although they have more than five deputies (7), they do not reach the required 15% in some of the constituencies they agree in in Catalonia.
The consent of the own group it is a provisional demand of the independentistas to be able to talk about the inauguration of Pedro Sánchez and he was one of the reasons that led ERC and Junts to support the socialist Francina Armengol as Speaker of Congress, as they secured a majority of the PSOE and Sumar against the PP.
in such a way that Sumar transferred two deputies to ERC of En Comú, so that they add their percentages of votes to those of Esquerra, so that the formation of Oriol Junqueras exceeds that average of 15% in all of Catalonia; and the PSOE has done the same by relinquishing four deputies from the PSC to Juntsso that those of Carles Puigdemont can also form their own group.
PP and VOX, watch out
There is a prescription in the scheme that can make things difficult. So the Article 23.2 of the Regulation notes that “under no circumstances can deputies belonging to the same party form a separate parliamentary group”, a measure taken to avoid what happened during the transition, when the PSOE was divided into socialist groups from Euskadi or Catalonia, in addition to the Spanish. And in the present case it could be interpreted that there are representatives of Sumar in two parliamentary groups (Sumar and ERC), and of the PSOE in two (Socialista and Junts).
Parliamentary sources expect the PP and Vox will be “very vigilant”. with the writings on file and it cannot be ruled out that there may eventually be an appeal against the consent of the ERC and Junts groups.
Benefits of having your own group
Having your own group means great political, economic and media benefits. Whoever forms it has guaranteed representation in all parliamentary committees, in the Permanent Deputation and a voice of its own in the Council of Spokespersons and the possibility to intervene in all debates on equal terms; while speaking times and committee seats must be allocated within the Mixed Group. In the control sessions, having its own group allows the introduction of quotas for questions and interpellations to debate with the government on a weekly basis, as well as advantages when it comes to including its non-legislative proposals in plenary sessions; on the other hand, in the Mixed Group all that ‘piece of pie’ must be shared equally.
On the economic front, having a group gives access to two types of grants: the grant awarded to each group by Congress – $364,160.64 per year (30,346.72 per month) during the last legislature – and the grant which the state provides free of charge. delivery of election propaganda during the campaign (mailing).
And the benefits will be extended for the next election, as those who now get it from their own group will have the opportunity to be present at future election debates and information coverage plans in the public media. For example, Junts was left out of RTVE’s debates and coverage plans in the 23J campaign because it failed to reach a group of its own four years ago, instead sharing it with PDeCAT, BNG, Compromís and Más País.
Previous steps to start the legislatureIf everything goes according to plan, Congress gets this XV Legislature eight groups parliamentarians: PSOE, PP, Vox, Sumar, ERC, Junts, Bildu, PNV and the Mixed, which will host the three deputies who do not belong to any political group (UPN, CC and BNG).
Once the parliamentary groups have been formed, and although this decision can be appealed, other important decisions for the functioning of the House can be taken, such as the adoption of a session schedule plenary sessions are the Council of Spokespersons and organizing the division of seats in the chamber, steps necessary to launch the legislature. From the beginning, the investiture debate by Alberto Núñez Feijóo already has a fixed date (26 and 27 September).
