More specifically, he has filed a complaint against the five judges of the Fourth Department of the Chamber for Administrative Disputes, who have not yet ruled on an appeal against his appointment as head of the Public Prosecution Service.
The Attorney General of the Spanish State, Alvaro Garcia Ortizhas challenged all the Supreme Court judges who have to decide whether or not he remains the head of the Public Prosecution Service.
Tax sources inform EFE that the Attorney General has filed a complaint against the five judges of the Fourth Department of the Chamber for Administrative Disputes. These have yet to be resolved source from the Professional and Independent Association of Prosecutors (APIF) against his appointment as head of the Public Prosecution Service, as his actions and his “partisanship” in favor of the government demonstrate that his appointment is not in accordance with the law.
These are the same judges who handed down a verdict last November that overturned the sentence appointment of former Attorney General Dolores Delgadoas a prosecutor at the Supreme Court, when he accused García Ortiz of “abuse of power” since “his goal was to ensure the promotion of Dolores Delgado to the highest category of the prosecutor’s career.”
This is why the Attorney General understands that these magistrates may not be objective in determining whether or not to continue to lead the institution once the General Council of the Judiciary has deemed them “suitable” for the position, precisely because, among other things, that Supreme Court ruling.
So things are, requests that his case be reviewed by other magistrates that they have no statements or references against him, as he understands, is now happening with this section of the Litigation Chamber.
The resolution corresponds to the so-called Chamber of 61a special chamber of the Supreme Court consisting of each of the presidents of the five chambers of the Supreme Court and the oldest and most modern magistrate of each of them.
