He European Court of Human Rights (ECHR) has filed a lawsuit against the former Catalan president Artus Mas against the conviction for the 2014 independence referendum, because he did not submit his comments on the case.
The Court, based in Strasbourg, France, announced on Thursday that neither Mas nor his lawyer had submitted their position observations after several warnings sent in recent months emphasizing that if they did not do so, the case would be archived.
The decision recalls that Article 37 of the European Convention on Human Rights provides that the Court may close a case where the circumstances lead to the conclusion that the claimant does not intend to pursue the case.
Artur Más filed the lawsuit in 2022, arguing that his rights had been violated by the Supreme Court’s 13-month disqualification sentence for disobeying the Constitutional Court and organizing the November 2014 consultations.
The Strasbourg Court today stated in its decision to file that the claim has been transferred to the Spanish Government, which has submitted its observations. The ECHR in turn sent those observations to Mas on October 9, 2023 and asked him to present his observations by November 20. Due to the lack of responses, the file has been closed.
