The chairman of the CGPJ asks to avoid government influence in the appointment of judges

Date:

Vicente Guilarte believes that appointments should be made within the CGPJ and subject to the principles of merit and capacity. For its part, the PP wants to meet the PSOE to reach an agreement, but “with the mediation of the European Commission.”

The acting president of the General Council of the Judiciary (CGPJ), Vicente Guilarte, has shown himself satisfied that Pedro Sánchez deems it necessary to change the election model for higher judicial positions, But has warned that “it’s not by no means allowed to promote any area government influence“, in the process.

Sánchez announced in an interview last Wednesday, June 12, that if the PP continues to block the renewal of the CGPJ, he will, through a parliamentary reform, change the power of the governing body of judges to make appointments to the Supreme Court. the higher courts.

In response to these statements, Guilarte has welcomed Sánchez into the “circle” of those who believe that the problem lies in the formula for electing high judicial officials and who consider it necessary. subject them to the principles of merit and ability.

This Thursday, Guilarte sent his “updated” proposal to the presidents of Congress and the Senate to change the system of appointment of the judges of the Supreme Court, the government positions of the judiciary and the appointment of the members of the governing body. of the judges.

According to him, the appointments of the TS magistrates “must continue to exist living in the CGPJ due to the necessity of constitutional logic.” Likewise, he defends that “there is no point in returning to earlier eras, albeit with different protagonists”, referring to the period when the Ministry of Justice was responsible for appointments.

He added that “under no circumstances is it permissible to promote any area of government influence, either directly or masked through an intermediary body or committee.”

PP reaction

For his part, the parliamentary spokesman for the Popular Group in the Congress of Deputies, Miguel Tellado, has warned that he will only meet with the PSOE if there is “mediation” from the European Commission, because Pedro Sánchez “is not trustworthy.”

Tellado has clarified that they have requested a “three-way” meeting with the Vice-President of the European Commission, Vera Jourová, in light of the “ultimatum and blackmail” of the President of the Government. However, he added that they have not received a response at this time.

In addition, Tellado wanted to emphasize that the times “will not be determined by Sánchez, no matter how desperate he is.”
