The TS archives the investigation against Puigdemont in the ‘Democratic Tsunami case’

The decision comes after the case was filed by National Court Judge Manuel García Castellón, who also investigated eleven other people. In both files, the case is being challenged by the nullity of the proceedings due to a procedural error.

The Supreme Court Judge (TS), Susana Poloarchived this Tuesday the investigation against the former Catalan president Carlos Puigdemont and the ERC alternate, Ruben Wagensbergfor the ‘Democratic Tsunami Cause’.

The reason is due to a procedural error by Judge García Castellón that he has not complied with the deadlines set by law for the extension of the investigation, to which he agreed 24 hours after the deadline.

The magistrate points out that before that date, which is the deadline for carrying out investigative procedures agreed by the National Court, “no investigation was carried out into the determining cause of the participation of those investigated in the events charged”, as can be seen from García Castellón’s archiving order.

In the said order “it is clear that no declaration has been agreed or taken from any of the persons examined – nor has it been taken from those certified in this case – which means that the proceedings cannot continue through the procedures of the abbreviated procedure.”

Before we knew the expected decision of the judge, Puigdemont has assured that the investigation into the Tsunami Democratic case “I just wanted to get muddy for years, to intimidate to key figures and dirty the story of independence”.

“The attack on reputation and the suffering that all this has meant for many people and their families is not undone by anyone. And it can happen again, let us be clear, because the supposed formal error does not prevent them from continuing to pollute and maintain their reputation. the suspicions on which they have built this case,” Puigdemont said in this regard in a message on X.

The Acting President of the Generalitat, Pere Aragoneshas celebrated the Supreme Court’s decision: “If justice is impartial, it has no reach.” In a message in ‘X’, Aragonès has maintained that this is a case built on false accusations of terrorism and that should never have existed.”

The acting government spokesperson, Patricia Plajahas praised the case’s record, as he has defended that no terrorist acts were ever committed during the independence process: “Justice has arrived, even if in a misleading way,” he stressed.

The spokesperson for the Spanish Government and Minister of Education, Vocational Training and Sport, Pilar Alegriaconfirms that the amnesty law is “taking its normal course”, after the filing of the ‘Democratic Tsunami’ case. In addition, Alegría has stressed that in the event that there are different criteria, “the one who must resolve these issues is the Constitutional Court.”

The deputy spokesperson of Add and a member of the commons, Aina Vidalhas criticized Judge García-Castellón for trying to play politics with the Tsunami case, as he assures that there was never any terrorism and that everything was up to the magistrate’s “infinite imagination”.

“I regret that it was a procedural error that overturned this case, which was based on the infinite imagination of this judge, who understood that the Tsunami case was a case of terrorism. No one understands it, not even the National Court,” Vidal said at a press conference in Congress on the matter.

On the contrary, the spokesperson for the PP in Parliament, Juan Fernandezcalls the filing of the case a “disappointment” and calls those involved literally unpunished.

The spokesperson for the far-right party Vox in Parliament, Joan Garrigahas assured that the Tsunami case was “a case of terrorism” before it occurred and has warned that “they will continue to fight” so that “those responsible are brought to justice”.
