The new regulations for mobile phone security will no longer be discussed before the National Council meeting next week. The current negotiations have not yet been completed and will be extended, as stated in a joint statement by Justice Minister Alma Zadic (Greens) and Constitutional Minister Karoline Edtstadler (ÖVP).
The aim is still to have a “timely new arrangement” by January 1. Negotiations have been “constructive and intensive recently,” the joint statement said.
“Decision not possible in September”
However, a resolution on the new regulation for securing data and data storage media in September is “not yet possible due to open questions”.
A new regulation is necessary due to the findings of the Constitutional Court (VfGH), according to which the current legal situation regarding the security of data storage violates the right to privacy and the Data Protection Act.
The passages will be closed at the beginning of 2025
The relevant passages will therefore be repealed at the beginning of 2025. This applies not only to the seizure of mobile phones and other electronic data carriers, but to all matters. Without appropriate new regulations, no more items will be seized from 1 January.
