The WKStA (Economic and Corruption Public Prosecution Service) announced on Tuesday that investigations against the former Secretary General of the Ministry of Finance, Thomas Schmid, would be stopped on suspicion of providing false evidence or would be postponed in further proceedings due to a defect to initial suspicion.
The original investigation was based on the initial suspicion that Schmid had provided false information when he was interviewed as a respondent in the Ibiza U Commission in June 2020.
In two cases the investigation was stopped
The investigation showed that Schmid’s relevant statements before the House committee were largely objectively correct on the one hand and that on the other hand they were recognizable as incomplete because he had exercised his legal right to identify himself as a suspect. in a corresponding investigation to reject the statement. The studies therefore had to be stopped.
In a further complaint against Schmid, he was accused of making false statements during his interrogation as a witness in the main hearing against Sebastian Kurz (and others) on charges of giving false evidence before the Vienna Regional Criminal Court in December 2023. .
Prosecutors see no ‘first suspicion’
The WKStA statement also said: “Due to a lack of initial suspicion, investigations were not allowed to be initiated in this regard, especially since there was no corresponding evidence for the alleged false information stated in the complaint in the witness statement and the court de De statement from MMag. Schmid was found credible in his assessment of the evidence.”
Both the rejection of the complaint and the termination of the investigation took place after approval of the corresponding project report by the Public Prosecutor’s Office of Vienna and the Federal Ministry of Justice in accordance with the Instruction Council.
