Netanyahu in Hungary – despite the arrest warrant: what happens if …

Date:

This is anything but a normal visit to the state: despite an international arrest warrant, on Wednesday evening in Hungary, Israeli Prime Minister Benjamin Netanyahu is expected. The most important questions and answers at a glance.

Prime Minister Viktor órban had invited Netanyahu last November and guaranteed him that he would not consider the international arrest warrant. The state visit is therefore eagerly expected.

What is the starting point?
Last November, the International Criminal Court adopted the arrest against Netanyahu for alleged crimes against humanity and war crimes in the Gaza war. However, the court itself does not have a police evening to arrest the searched person. The contracting states must do that.

Should Hungary arrest Netanyahu?
Hungary is one of the 125 contracting states of the court. It ratified the basic contract, the so -ramped Roman status. After that, Member States are obliged to carry out orders from the court. You must perform arrest statements if there is a searched one in your territory. Hungary must arrest Netanyahu accordingly.

So the arrest warrant was announced last year by the court:

There are no exceptions, says the Criminal Court. If states are worried, they are free to consult the court, said a spokesperson for the Criminal Court in The Hague. “However, it is not a matter of the states to decide someone on the literity of the legal law of the Court of Justice.” Finally, decisions of the court can also be challenged before the court.

Is there no immunity?
This is about a basic principle of the World Criminal Court: everyone is the same for the court, and nobody can avoid an office of law enforcement. An international arrest warrant was also given against Vladmir Putin.

What happens if a state does not suffice?
If a state does not meet its contractual obligation, the court can submit the case of the conference conference. And this can then decide against further measures against this state. But that will hardly have any major consequences. There is a lot at stake in court. If his orders are ignored, this undermines the authority of the court.

Hungary is the first European country on which Netanyahu travels after publishing the arrest warrant. But it’s not alone. France, Italy and Poland had already suggested that they would not force the arrest warrant. The future German Chancellor Friedrich Merz had also announced that they wanted to invite Netanyahu in Germany.

He would find ways that this does not have to be arrested. Austria had criticized the court’s decision, but would probably carry out the arrest warrant.
