As the black and white team said in a note, the Commercial Court of Badajoz ordered the Royal Spanish Football Federation (RFEF) in June to pay financial assistance to the team for participating in state-level competitions from the sale of television rights and other concepts, an amount set even in €189,177.
“An amount the club has so far not received, since the RFEF appealed the resolution that ordered the payment”, revealed the black and white creature. In this context, this Thursday the resolution of the sole judge was issued that prevents him from registering, due to the existence of bankruptcy debts to the players in the amount of 77,828 euros, an amount “less than the debt of the RFEF to the club “.
“The club proposed to the RFEF that it would retain the said amount in any case and will pay the difference until the obligation to pay some bankruptcy credits is clarified in court which, if paid, may generate many challenges from other bankruptcy creditors who will see their situation damaged, due to the blatant violation of par conditio creditorum ” , explained CD Badajoz.
Before the resolution, on June 28, the court was asked for judicial assistance consisting of the adoption of “prompt” precautionary measures, with the aim of requesting the RFEF “to, among others, render null and void any agreement, precautionary measure or resolution already issued where CD Badajoz is prevented from registering and processing this registration in the Second RFEF”.
In accordance with the previous request, the court issued an order in which the hearing of the precautionary measures was set for July 18. For its part, and within the period indicated for the purpose of 48 hours, the club “the corresponding appeal against the resolution of the single judge will be filed”, he announced.
Meanwhile, “The ownership of CD Badajoz is working tirelessly to continue the club’s viability and produce a squad to go out and compete on September 2 in Group V of the Second RFEF,” after its relegation from in the sporting category.
