Luis Rubiales’ term as RFEF president is over. This follows, according to sources consulted by MD, after the decision of the 90-day precautionary suspension imposed this Saturday by the FIFA Disciplinary Committee and as a result of the opening of the file on Thursday by the highest body in world football.
Luis Rubiales is now and for the next 90 years disabled for any role as RFEF president, at UEFA and FIFA level. A suspension that can be extended for another 90 days if during that time there is no resolution of the file which, in formal conditions and in accordance with the procedure of FIFA, should be in three months. But given the seriousness of what happened, and according to the same sources consulted by FIFA, this disciplinary procedure could be accelerated.
Because it also appears that the president of the FIFA Disciplinary Committee, the Colombian Jorge Iván Palacio, is a person particularly involved in all matters of abuse of authority, integrity, etc.
The only temporary suspension today reflects the seriousness of the facts and that Luis Rubiales has been exposed to a harsh penalty of suspension for a period of time. The FIFA Disciplinary Code does not set this time but, just following the Code of Ethics, we start with a minimum of two years for notorious acts and abuse of authority. But, in an extreme case, it can be forever. It is precisely for this reason that the Disciplinary Code does not establish a time, to set the same in FIFA.
We don’t have to wait for the decision of the CSD and the TAD
This means we no longer have to wait for the precautionary suspension of the CSD, and as soon as the TAD opens the file next week. Luis Rubiales will not be able to serve as RFEF president later, for now and as RFEF has communicated. From now on it is Pedro Rocha, president of Extremadura and vice president of the RFEF, who exercises this presidency and initially while the suspension is executive. The RFEF Statutes state the following: “In cases of absence, illness or any reason that temporarily prevents him from performing his duties, the President will be replaced by the Vice Presidents, in their order; in their absence, by the Treasurer and, ultimately, by the most senior member of the Board of Directors, or by the most senior if it is the same.”
There will be what will be called an election once FIFA announces the time of the disqualification
But as soon as the file is resolved and the FIFA disqualification time is known, the RFEF has to call RFEF elections according to article 31 of the Laws it is clarified that: “If the President ceases for reasons other than the end of his mandate, the Board of Directors shall become the Management Committee and shall call elections to fill the position; the one elected shall occupy the position for a time equal to the time remaining. to fulfill the replaced, in addition to the application, as far as it is concerned, of the rule set for article 23.2 of this legal system“.
If he did not do it then and tried to extend Pedro Rocha’s mandate until 2024, taking advantage of the fact that it is an Olympic year and the electoral process must be carried out; FIFA can ban all Spanish teams and teams from participating in international competitions.
The seriousness of Luis Rubiales and the RFEF is evident in the text published today where he ordered the two not to contact the player Jenni Hermoso.
A decision that should not harm the 2030 candidacy
This decision by FIFA and a categorical proposal is good news for Spain and the candidacy of 2030. There is only one year left before his election and during that time Luis Rubiales will not be safe. Pedro Rocha may be there if he is elected in the electoral process once his disqualification is known; Or the Federation can be immersed in other elections and within the second semester of 2024.
