There is a date for the oral hearing of the ‘Super League case’ in Madrid. As MD found out, Commercial Court No. 17 of Madrid that handles the procedure in Spain has scheduled an oral hearing for this case for next March 14, at 10:00 am The hearing is expected to take place in one session. This is the first call after the Superior Court of Justice of the European Union announced its resolution about this Super League and the possible conflict with UEFA and FIFA on December 21.
The Super League company organization has definitely filed a case in this Commercial Court number 17 of Madrid against UEFA and FIFA, for alleged abuse of position and anti-competitiveness, as a result of the threats that made by both organizations, in the sense that the Clubs participating in this new competition may not be included in the competitions of the two aforementioned organizations.
The Court accepted the claim and adopted precautionary measures to order UEFA, FIFA and the various federations to refrain from the conduct preventing the start of the Super League, during the processing of the judicial procedure.
Then, the Commercial Court of Madrid raised a preliminary decision before the CJEU by order of May 11, 2021. In its request, the Court of Madrid indicated that the jurisprudence showed that sports activity is not included in the scope of the application of free movement provisions and competition rules. The Court affirmed that they maintain a position of monopoly, of dominance, which allows them to act independently with respect to any other potential competitor.
The decision last December 21 meant an end to the exclusivity that UEFA granted itself to organize European club competitions; but this does not indicate that its role as regulator of continental football is coming to an end. That is, the decision allows the emergence of new competitions organized by third parties, but the TSJEU document also recognizes UEFA’s role as the governing body of European football.
That is, it will continue as the controller of the authorization of these new competitions and legitimize its power to authorize any club competition that other companies wish to organize, as long as the UEFA do so with clear, proportionate, transparent and non-discriminatory criteria.
