The racist controversy between Acerbi and Juan Jesus, a closed case

Date:

The so-called ‘Acerbi Case’ that exploded in ‘calcio’ on March 17, when the Brazilian John Jesus accused Francesco Acerbi of uttering a racist insult during a match between both teams, the Italian international was disallowed due to lack of evidence and only Gabriele Gravina, president of the Italian Football Federation (FIGC), can now change the decision.

Analysis of the photos and interrogations conducted by the FIGC Prosecutor’s Office determined that there was insufficient evidence to prosecute Acerbi, who faces a minimum penalty of 10 game suspension.

Entry through trade, unlikely

John Jesus, that once the sentence is known, he assured in a statement that he did not feel protected by the system, only now he can hope Gravina enters ex officio to withdraw the sentence and despise the establishment that he himself was in charge, something, in any case, unlikely.

“The sports authorities, different from the criminal authorities, do not reach the level of evidence needed to convict someone,” the lawyer told EFE. Angelo Cascellasports law expert and former member of the European Court of Arbitration for Sports (CAS).

Final decision, according to sports law

“According to sports law, this decision is final. The only one who can change it is the president of the Italian Federation. Gravina can say that the decision is not correct and open another procedure, something he can only do when there is a very important violation of the judicial process,” Cascella added.

Juan Jeses, in matters of sports justice, can only cling to article 102 of the Sports Code law: “Gravina can only enter if the sentence is illegitimate or inadequate. He has 60 days to do so,” said the lawyer.

Gravina has until May 25

Therefore, the federative president has until May 25 to intervene.

Gravina’s opening of a new process would show that the FIGC prosecutors, from his own organization, made blatant mistakes, so he is not expected to intervene.

However, John Jesus had a second method in case he wanted to continue defending his position.

“Another thing that Juan Jesús can do is sue Acerbi, but not in sports justice, but in the ordinary court,” Cascella pointed out.
