Is Frenkie de Jong forced to take the salary?

This past June we gave you all the details about the possible salary reduction in FC Barcelona. The issue that re-entered the scene before the scenario of Frankie de Jong and the double solution proposed by the club: either salary reduction or transfer.

Well, as we said before, the Barcelona can unilaterally reduce both the Frankie de Jong like other players in the squad, to reduce the salary mass.

Companies, in this case or a club or SAD, have to pay workers the salary agreed in the employment contract and always respect the minimums established by Collective agreements for the position held. But sometimes companies want or need to reduce labor costs through lower wages.

When there are economic, technical, organizational or productive reasons, the salary can be reduced by a significant change in the working conditions. These types of changes are specific, and depending on the number of workers affected, the proposal will be individual or collective, the way of carrying out the change will be different in each

The aforementioned article 41 of the Workers’ Statute states the following:

“The company may agree to major changes in working conditions when there are proven economic, technical, organizational or production reasons. Those related to competitiveness, productivity or technical or organizational work in the company will be considered like that.

They will be considered as major changes in working conditions, among others, those affecting the following matters:

a) Working day.

b) Schedule and distribution of working hours.

c) Shift work regime.

d) Salary system and salary amount”

A change that, within ninety days, affects at least:

a) Ten workers, in companies employing less than one hundred workers.

b) 10% of the number of workers in the company among those working between one hundred and three hundred workers.

c) Thirty workers, in companies employing more than three hundred workers.

The change that, in the established reference period, does not reach the limits indicated for collective changes is considered to be of an individual nature.

Faced with this unilateral decision from the company, in this case the Barça team, there can be three different scenarios for the workers. In other words, both De Jong and the other players affected by this reduction can use the following position:

1- Accept them

2- Not accepting them and fighting them before the Social Courts.

3- Not accepting them and breaking the employment relationship, having the right to compensation of 20 days per year (with a maximum of 9 monthly payments) and the right to unemployment. The players in this case will be released, it will be notified 15 days in advance, and can go to another club.
