So you can legally sleep in the car

Date:

Depending on the situation, we may be fined

To sleep in the car, several factors have to be taken into account, as it is not allowed in all cases. The law distinguishes between staying overnight and camping, because while the former is possible in most cases, the latter is only allowed in authorized areas and can lead to a fine if you camp where it is not allowed.

If we have traveled several kilometers by car and it is night time, it is normal to feel tired and it is advisable to stop to rest and sleep as it may affect our driving behaviour. Although this is not possible anywhere and in any way, because depending on the situation, we could be fined.

Understand the law by spending the night somewhere and as the car is considered a private space it is perfectly legal although this requires it to be parked properly and with all papers in order i.e. pass the ITV and have insurance and taxes paid. The difference between overnight and camping is that the law considers camping when the perimeter of the parked vehicle is extended. This happens when objects are brought out, increasing the measures in the technical data sheet. It is also considered camping when liquids are discharged on public roads or posts are placed. It is illegal to camp within a built-up area or in an area that is not authorized for that purpose.

The fine for camping on the street differs per municipality, as the municipality is responsible for imposing the fine. Although there are areas that are not part of the urban area and where parking is also completely prohibited. This is the case with national parks, where the fine can be up to 5,000 euros if you camp inside.
