A beautiful day on a farm on Thursday evening – as reported – took a tragic turn for eleven-year-old Gabrijel C. from Burghausen (Upper Austria) and his whole family. Shortly after 7 p.m., the boy and his brother were out in a field in a Hoftrac with a 30-year-old local resident in Überackern.
According to the official police report, while driving, the man “left the steering wheel to the 11-year-old who was sitting next to him”. However, due to inexperience and a steering error, he hit a pile of undergrowth with the left front tire of the vehicle, causing the vehicle to overturn.
While his brother and the farmer were unharmed, Gabriel was thrown from the cab and his head caught between the roof and the road. All attempts at CPR by the helpers failed.

The 11-year-old was definitely too young to drive the tractor himself. The law states: “Children under the age of five may not be taken on tractors. Children between the ages of 5 and 12 are only allowed to drive if the approved seat is in an enclosed driver’s cabin.”

If the 30-year-old tractor driver is actually charged with gross negligence by the public prosecutor and then goes to trial, the man risks a prison sentence of up to three years under Article 81 StGB. On April 12, an 11-year-old was also involved in an accident in Oberhofen am Irrsee when he was riding his mother’s moped without permission and collided with an oncoming tractor handlebar in an unlit tunnel. Here too there were complaints against the mother and tractor driver on suspicion of culpable homicide. After the accident in the Freistadt district on June 24, in which a nine-year-old partially ran over his own mother with a tractor, there will be no criminal consequences. If the suspects are close relatives of the victims, distraction is a commonly used solution. To do this, all the circumstances must be clarified, as well as the responsibility for the accident.
