Judgment in Strasbourg – success for Russian woman after forced abortion

A Russian woman has been awarded €19,500 in damages from the European Court of Human Rights for a forced abortion. The prosecutor, who was forced to undergo an abortion at the age of 20 under pressure from her parents, was treated “inhumanely and degradingly”, according to Strasbourg judges, according to Kathpress on Tuesday.

They rated the loss of the unborn child as “serious direct damage to their health” and referred to “long-term negative physical and psychological effects”. According to the verdict, the parents had urged their daughter to have an abortion because the child’s father had been arrested for an alleged criminal offence. The termination took place in a public clinic, although the young woman made it clear that she wanted to continue the pregnancy.

Russian justice saw ‘no bad intentions’
A later complaint by the woman was unsuccessful to the extent that the Russian judicial authorities acknowledged “no malicious intent” in the parents’ actions. The clinic refused to initiate disciplinary proceedings against the doctor in question. After a civil lawsuit, the woman was awarded the equivalent of 500 euros in damages, with the court in Russia ruling that she had not had any serious health problems.

Since September 16, Russia is no longer a party to the European Convention on Human Rights. However, the Strasbourg Court can still rule on complaints about facts prior to that date.
