A business executive in Linz was visited by the immigration and financial police after hiring a Chechen who had lived in Upper Austria for years. A data protection confusion, where the labor market service can do nothing if it mediates “illegals”.

“Six men from the immigration, finance and city police stood next to me in the courtyard and asked about Ismail,” reports a pissed-off Linz company boss, who is now facing a complaint for hiring an illegal worker. “He has been in Austria for 19 years, I have always employed him and he was also in the AMS system,” the employer does not understand the world.

The background is that the Chechen (54) had to surrender his congress passport in June and as a result lost his work permit. “But apparently no one has been reported,” says the head of the company, who was informed by the financial police that he is responsible for checking whether someone has a work permit. “I didn’t think it would be a problem if I hired or found someone from the employment agency,” said company head Linz.

Data protection confusion cause for trouble
Of course, the “Krone” asked the AMS Upper Austria how that is possible and – in short – a confusion about data protection is the cause of the whole disaster. “Of course, when applying, we check whether someone is legally allowed to work in Austria and is therefore entitled to an AMS benefit,” explains Iris Schmidt, deputy head. “Then the clients commit to reporting it if anything changes,” says Schmidt — the counselors — who are usually the same — not asking every time they contact a client if the status is still valid.

However, there is no report from the Immigration Police to the AMS that a person’s work permit has been revoked. The health insurer, to which employers have to register their people, also receives no information – reason: data protection.

Otherwise it is different. There’s the data comparison and then it comes out when an “illegal” is registered and used quite regularly – and the police for finance and foreigners come knocking. Incidentally, the Chechen concerned cannot be deported and is also thrown out of the AMS system.
