The Spanish Data Protection Agency (AEPD) fined the courier company UPS for the delivery of an order placed over the internet to a neighbor of the recipient without his permission.
The events go back to March 2021when the person who made an online purchase from Media Markt reported that the UPS delivery person had left the shipment to another person, so their personal information was transferred to a third party without their consent.
After analyzing the documentation on June 7, 2021, the director of the Spanish Data Protection Agency issued a resolution agreeing not to allow the claim for processing.
However, Plaintiff has resource against United Parcel Service (UPS), the party responsible for protecting customer data.
The resolution states that the contract between Media Markt and UPS provides that “if the recipient is not available, the package may be dropped into the mailbox of the recipient’s address, if deemed appropriate, or delivered to the neighbor unless the sender has excluded this delivery option by choosing the applicable additional service”.
