A few months earlier, the defendant – a father of two – had received a rebuff from a waitress. On the day of the crime, she was partying with two men in the neighboring restaurant. One is the friend of the beloved, or so the 48-year-old thought. This infuriated him and led to the fatal mistake: Suddenly he pulled out a butcher knife with a blade 12 inches long. “I’m stabbing you now!” he yelled, lashing out at his victim, who was completely surprised. Recognizing the imminent danger, his friend threw himself between them and repelled the attack – and got the knife rammed in the stomach himself! Fortunately, he survived the attack.

The jury finally sentenced the man, who has always maintained his innocence, to eight years in prison for attempted murder and grossly negligent bodily harm. But now the Supreme Court has decided to overturn the verdict against the West Styrian. The reason: In this case, the menacing words “I stich di ob” need not mean that the host actually wanted to kill the supposed opponent, but only wanted to hurt him badly.
