The artists had announced it – now the time has come: a model lawsuit against the Salzburger Festspielefonds has been filed with the Vienna Labor and Social Court. This governs contracts and payments. The contractual partner must be the Concert Association of the Vienna State Opera Choir, which in turn is “employees” of the Salzburger Festspiele during the festival.
“Drastic deductions” for those who missed the preliminary rehearsals
However, a “declaration of commitment” was required, such as participation in preparatory rehearsals. At the same time, an employment relationship was “explicitly excluded” and there was no registration for social security. And those who miss the preliminary rehearsals should accept “dramatic inferences”. A gag contract that violates Section 7 of the Theater Employment Act!
The lawsuit is worded accordingly: direct employment subject to social charges from the first day of pre-rehearsal, any deductions strictly in accordance with the Theater Act.
The controversy has been simmering for quite some time
The dispute has been smoldering since the times of the Corona lockdown. The festival speaks of “force majeure”, but at the same time emphasizes that it was the only major festival to play in 2020 and employ hundreds of artists. After the season, they agreed on their own provisions governing deposits in case of necessary cancellations in the future.
