Although not calibrated, the police used the weighbridge at the customs office in Niklasdorf (Styria) for many years. Lawyer Marc Simbürger found abuse of office, after all, many truck drivers had been wrongly punished. Now the device is even disassembled.
For years, the police used a weighbridge at the Niklasdorf customs office for checks. The fact that it is not calibrated at all came to light during an administrative procedure against a timber transport company from Upper Styria: a driver was sentenced to weigh and it was found that the truck was overloaded.
Lawyer Marc Simbürger objected and discovered the case of what he claimed was abuse of the scales. Because: The police knew it was not calibrated. From a legal point of view, this is not a problem, it was said when the police press office responded to a “Steirerkrone” request.
criminal charges filed
Simbürger eventually filed a report with the public prosecutor’s office in Leoben for abuse of office. However, he sees no initial suspicion and does not investigate. What the lawyer doesn’t understand. Because: “It is not about one, but about numerous fines that have been imposed over a period of almost ten years.”
Weighing is no longer possible
Making the case even more explosive: Shortly after the report, the scale was taken out of service and the display device removed following an official action by the Graz Weights and Measures Office. The police must now swerve.
