No admonitions or warnings are known – in 13 years as a contract employee in the Tyrolean police, the suspect was not guilty of anything. But last year the bang effect: the boss took a so-called notepad from the 54-year-old’s office. On the back she discovered a registration form with her own details – apparently printed by the subordinate, which he now denied at trial.

An investigation followed and it emerged that the suspect had had access to the driver’s license and registration register 13 times since 2017. With one exception, they were names of colleagues. “As a result, the fundamental right of these people to their personal data has been violated,” said the public prosecutor. The defender raised a lack of internal training on access regulations.
Birthday claimed as motive
“I just wanted to know when her birthday is to congratulate her,” the defendant justified in one case. “And the other requests?” asked the judge. “I don’t know,” muttered the suspect.
There is a suspicion of abuse of office. The testimony of his boss, who was on vacation, was adjourned. This should explain, among other things, how detailed access rules were explained.
