Trial in Innsbruck – fine after forbidden questions in the police PC

A contract employee (55) of the Tyrolean police repeatedly leafed through the driver’s license and registration register for years and illegally requested official data. He only wanted to know when a colleague’s birthday was, according to the deaf defendant. He has now been convicted of abuse of office.

A piece of paper was his downfall! Because the boss of the deaf 55-year-old, who as a contract employee with the Tyrolean police had never committed anything, had written instructions for him on the sheet. On the back, however, she discovered an illegally printed registration form.

Birthday wishes as a goal
An investigation followed and it emerged that since 2017 the official had unlawfully requested official data from the driver’s license and vehicle registration register on a total of 13 occasions. “I can’t remember why I did that,” the accused tried to convince the jury in sign language. He only knew for sure after two questions from a colleague: “I wanted to know when it was her birthday so I could congratulate her.”

The jury was only partly of the opinion that the Tyrolean was not well informed about data protection regulations due to his disability, his lawyer explained. “They pretend to be more ignorant than they are,” Judge Helga Moser said. The suspect was – not legally binding – sentenced to a half conditional fine of 6840 euros.
