Compensation claims – sexual harassment: ORF manager sues broadcaster

A former ORF manager allegedly sexually harassed and bullied an employee. The woman, herself a high-ranking ORF manager, is now going to court. She feels let down by her employer and demands compensation.

As the “Presse” reports, the employee, who began her ORF career more than 20 years ago, is said to have been repeatedly sexually harassed by her former boss.

Procedure has been stopped
At first she tried to clarify the incidents with him personally – without success. She also achieved nothing with the management of the ORF. She then went to the internal equal opportunities committee of the ORF. As the “press” was informed, the proceedings were stopped due to lack of evidence. However, the employee could no longer work with her boss, so the employee was transferred at her own request – and thus lost important areas.

The supervisor left ORF and the manager then wanted her old job back. Under former general manager Alexander Wrabetz, it was agreed that she would regain all previous territories if she remained silent about the alleged attacks in exchange, the “Presse” reports.

Because this agreement was not fulfilled, the employee is now suing the ORF for compensation. She feels disadvantaged because of her gender in filling her former boss’s position.

ORF: “No legal basis for lawsuit”
The broadcaster contradicts this representation: “The ORF sees no legal basis for the lawsuit because there is an existing equation that is also adhered to,” quoted the “Presse” ORF lawyer Katharina Körner-Risak. From the ORF’s point of view, the matter “was responded to accordingly and the matter was resolved to the satisfaction of all concerned at the time,” it told the “press”.

That is why the case will go to court next week. On the first day of the hearing, the plaintiff and the defendant’s managing director, Roland Weißmann, will be questioned. Further appointments are planned, in addition to other ORF managers, ex-ORF boss Alexander Wrabetz is also to be questioned.
