No follow-up – permanent cause Ischgl is finally off the table

With the long-term cause of Corona in Ischgl, it remains the case that there will be no criminal consequences. The tri-judicial senate of the regional court in Innsbruck did not follow up and partially rejected a so-called continuation request from 51 victims, the regional court announced on Friday.

As early as November 24, 2021, the prosecutor’s office has stopped the investigation into the Ischgl case. As reported, it involved a possible risk to humans from communicable diseases. Specifically about the actions after Corona cases and the departure from Paznaun.

Among others, the director of the Tyrolean state office, the district governor of Landeck and the mayor of Ischgl were investigated.

Decision comprises 400 pages
The Consumer Protection Association (VSV) indignantly submitted a follow-up request. On Friday, the regional court announced a 400-page decision. The petition was therefore “inadmissible and unfounded on formal grounds”.

In concrete terms, this means that the continuation applicants are partly not entitled to submit such an application. On the other hand, the decision of the Innsbruck public prosecutor’s office to stop the proceedings is “not objectionable”.

Civil proceedings are not affected
The pending civil suit must be separated from the decision and unaffected. Most recently, the VSV filed a class action lawsuit for 121 Covid-infected people against the Republic of Austria and the state of Tyrol at the Innsbruck Regional Court with a disputed value of almost €3.4 million.
