My child is suddenly ill, care is not possible – how do I get care leave? AK employment law expert Oliver Scharbl knows all about it.
Employees are entitled to paid care leave for the necessary care of their sick child and for the necessary care of their healthy child if the person caring for them is absent for serious reasons (eg because they are ill). This is independent of whether you and your child live in the same household.
The scope is one weekly working time per working year from the commencement of employment. Employees are entitled to a second week of care leave within a working year if their child under the age of 12 falls ill again and needs care – again for the extent of their weekly working time.
Notify the employer immediately
Care leave can be taken weekly, daily or hourly. The employer must be informed as soon as possible. If the employer requests a medical certificate as proof, he must also bear any costs.
