A highly unusual affair involving a newlywed couple on their wedding night brought two young men (17 and 18 at the time of the crime) to trial in Vienna’s regional court. According to the indictment, they allegedly sexually assaulted the artist in her studio while she was defenseless. Tuesday the bang: acquittal for both suspects.
Whimsical, bizarre, contradictory – words often used on Tuesday in the ongoing trial of a bride being sexually assaulted on her wedding night in room 306 of the Vienna court.
The groom was in no mood to celebrate
As the “Krone” reported, in February 2022, on the evening after the wedding, which she spent without a husband, a woman from Vienna spontaneously invited two young men (17, 18) to her studio. “Music was heard, drunk and danced,” explains the lawyer of the second suspect. Sexual intercourse between his client and the newlywed eventually ensued. The first suspect, who was also drunk, only tried it because of erection problems.
Did a pill disable the woman?
“Never in my life would I voluntarily want to have sex with the perpetrators,” the prosecutor quotes from the contradictory questioning of the victim, pinpointing sexual abuse of a defenseless person. Also because one of the two defendants gave the woman a drug in tablet form that increased her drunkenness and made her completely incapacitated.
The suspect speaks of consensual sex
“Loss of memory is not the same as powerlessness,” argues the defense lawyer and, like the young defendant, speaks of consensual sexual acts.
Prosecutor announces appeal
After a 30-minute deliberation, the jury ruled: the teens were acquitted. “There are different variants. The course of the evening can no longer be determined,” said the judge. The duo were also cleared of the charges of theft and damage to property. The public prosecutor announces a nullity complaint and appeal. Not legally binding.
