Despite the activity ban – abuse: Ex-teacher gave courses for children again

In Lower Austria, an already convicted ex-teacher is said to have returned to work with children and young people after serving his sentence for sexual abuse, despite a work ban from the court. Among other things, the teacher offered art courses for young people.

It was not until December 2022 that he would have held a workshop in a facility for young people aged 14 and older in the Neunkirchen district. Because he violated a profession forbidden to him, the pedagogue will soon have to answer to the court of Wiener Neustadt. He risks a prison sentence of up to six months or a fine of up to 360 daily rates.

Further attacks “are currently unavailable”
According to Puls 24, the hearing should take place at the end of May. Markus Bauer, spokesman for the public prosecutor’s office in Wiener Neustadt, confirmed on Thursday the existence of a corresponding criminal charge. Only the prohibited exercise of the profession was charged. There is currently no evidence of abuse by the ex-teacher at the affected facility or elsewhere,” said Bauer.

Two years in prison
The former teacher was sentenced to two years in prison by the regional court in Wiener Neustadt in 2017 for serious sexual abuse of minors, abuse of authority and making images of child abuse. In addition, he was not allowed to work as a teacher, educator and caretaker of minors.

Sex with 13 year old
The teacher had entered into an intimate relationship with a student and had sexual intercourse with her several times in his apartment. The married father was 37 at the time of the crime and the girl was 13 years old. Young people between the ages of 15 and 20 would have participated in the workshop that the now 42-year-old held four months ago at the facility in the Neunkirchen district.

Facility waived criminal record
The criminal record had been expunged at the time, but the facility apparently refrained from obtaining a comprehensive “child and youth care criminal record certificate”: according to the Pulse 24 report, no background check was conducted and the facility was not aware of the prohibition of activities. According to Puls 24, the facility precludes the 42-year-old from sitting alone in a room with young people during the workshop. There were always three employees there.
