The Supreme Court of the Basque Country (TSJPV) is based on the lack of sufficient objective data to restrict the right of assembly and therefore endorses the protests of the collective Ertzainas in battle for the Basque Parliament. Regarding the interruption of the tram service, the verdict implies the lack of reports from the local police or Euskotren in this regard.

The judge of the TSJPV Luis Ángel Garrido believes that describing the degree of affection that the tram could suffer at the protest of the ertzainas is essential to justify the restriction of a fundamental right. Therefore, according to the sentence, it is impossible to know whether the order is proportional.

Something similar occurs with the ban on using the public address system. According to the verdict, the prohibition is simply unreasonable, because its use is, according to the verdict, essential for the awareness of the claims. And again, a lack of data is alleged: “no element has been provided that would lead to determining the extent to which the noise from the demonstration could affect parliamentary activity.”
