The OGH, whose decision is at the disposal of the “Krone”, sees “an urgent suspicion that he deliberately killed his 6-year-old son by throwing him into a flooded river”. He “hit the back of the head with a glass bottle he brought to the scene of the crime, causing a superficial crush.” Leon’s father is said to have stayed there until a passerby saw him.
“Months of Deception”
According to the Supreme Court, it was a “murder that had been planned for a long time and that had been meticulously prepared in terms of execution, but above all in terms of cover-up”. A month before the crime, the family man googled “passed out”. The Supreme Court assumes that law enforcement officials and the public have been misled for months, including with the promise of 30,000 euros.

The child’s illness was a burden. And even now, the OGH sees the danger that the suspect – for whom the presumption of innocence applies – could respond with “massive violence against fellow human beings” with regard to the criminal consequences.
