Shock for a couple from Carinthia after a holiday in their own state: Five months into their stay, a property interference lawsuit was filed because the two had parked their car on private property while unloading their skis. The costs for this are terrible – and the judiciary is looking at such scams.
The Supreme Court has actually already rejected the scam with infringement cases against short-term parkers on private property. Protecting property is important, and of course no one should simply park on someone else’s property – but the highest courts have rejected claims of several hundred euros in such cases as completely excessive. However, each lawsuit is assessed individually; there is no uniform case law. And some people shamelessly abuse this.
