It is one of the current prestige projects of the city of Vienna: the multifunctional arena in Neu Marx. From 2029, top international acts should have played their concerts here and major sporting events should have taken place here. However, the schedule wobbles wildly. Because the city has to re-tender the multi-million dollar project. The administrative judge has now decided that.
You are almost reminded of the Nordziekenhuis or other major projects in Vienna – at least of a Schildbürger joke. The administrative judge annulled the award to the municipal partner for the multifunctional arena for formal reasons. ‘OVG Bristol Limited’, which emerged from a committee of experts as the best bidder for the multi-million euro project (384 million euros), was apparently too ‘opaque’ for the court.
Repairs excluded
Martin Schiefer of the law firm Schiefer Rechtsanwälte GmbH, which was commissioned by Wien Holding to carry out the tender process: “The court mainly bases its decision on the fact that the change in the composition of the bidding consortium, the background to the change in the original bidding consortium, which was also determined by the administrative judge that it could not be clarified, is inadmissible.” The court’s ruling now also rules out any improvement in the offer.
Even the inferior team comes away empty-handed
The whole thing was also preceded by a request for review by the reports “CTS Eventim AG & Co KGaA” for annulment of the award decision or for a ban on concluding the contract. The court has now allowed this. But CTS Eventim will also not receive the contract, because CTS Eventim’s bid entails many times higher construction costs and additional payments from the city of Vienna compared to OVG’s bid. As a client, Wien Holding wants to refrain from an audit and must now reopen the award process.
Delays have been taken into account
Did Wien Holding already expect this? This question inevitably arises. Wien Holding is certain: “As a prudent customer, the overall timetable has already taken into account the duration of a tender control procedure and a possible repetition of the tender procedure, so that the decision of the Vienna Administrative Court will not lead to any form of tender. project delays.”
