After the fatal shots on January 5, 2021 with a service weapon and a taser by a WEGA special unit on an elderly (67) in Vienna-Hietzing, the investigations have now been discontinued despite witnesses.
The results were announced on Friday by authority spokeswoman Nina Bussek. It is therefore clear that the officer who fired the fatal shot will not be held criminally responsible. After extensive investigation – several expert reports were also obtained – the Public Prosecution Service came to the conclusion that this was a self-defense situation and that the use of weapons was justified, according to Bussek.
The officers involved in the operation “behaved according to regulations” and firing the shot was justified to repel an on-going attack.
Officers attacked with a knife
The pensioner is said to have first attacked a domestic worker with a knife and then attacked officials of the WEGA special unit. The 67-year-old held the knife over her head. The officers then used a taser and fired a shot with a service weapon – this happened almost simultaneously. For the prosecutor’s office, the justified level of defense was not exceeded, nor was a manifestly inappropriate defense presented.

The WEGA troops immediately carried out first aid measures because the woman had been hit in the upper body. Shortly after, she was taken to hospital and died a short time later. The retiree is said to be mentally retarded, her adult representative had taken care of her domestic help, which she reportedly disagreed.
