However, she must pay compensation for pain and suffering and contribute to the dog’s treatment costs. The animal requires psychological care after the incident.
The death of a jogger after an attack by an American Staffordshire terrier in Upper Austria fueled the debate over protected dogs. One of these, in particular a bull terrier, was now also dealt with by the Vienna-Döbling court. The said dog was walking around without a muzzle and without a leash outside the dog zone in the Wertheimstein Park, where at the same time a pharmacist was walking her Sheltie.
Bite on the neck
The bull terrier ran up to the dog and bit her on the neck. Because the pharmacist wanted to help her dog, the terrier bit her on both hands: the result was sick leave and two courses of antibiotics.
A settlement is reached in court
“After the incident, the female dog was extremely aggressive, more unpredictable and no longer as cuddly as before,” reports attorney Gunther Gahleithner, who represents the plaintiff pharmacist. The Sheltie dog therefore even had to receive psychological care. A settlement was reached in court. The owner of the bull terrier must pay compensation and a treatment contribution of 2,000 euros. The criminal case against the Ukrainian was stopped because the injuries were not serious enough.
