Guilty and not
The defendants were a 19-year-old Syrian who admitted hitting him “with a half-open fist”, and a 17-year-old from Bad Sauerbrunn who allegedly finished the falling victim with brass knuckles. The first to plead guilty, the youth denied to the end that he was even present.
Fell over in the wardrobe
Twenty witnesses were interviewed. There were conflicting statements. It was agreed that the victim had molested youths in the basement. A blood alcohol level of 2.46 was measured for the 42-year-old, who “fell over like a plank in the wardrobe” shortly before the incident, according to two witnesses. The motionless man was dragged outside the stairs and placed against the wall of the house. He himself could not walk.
Moments later, the Syrian confronted him. After receiving a blow, the student struck back. Some claim to have seen the second suspect also commit suicide.
Unexplained cause
On the third day of the trial before the lay court in Eisenstadt, two experts spoke. Both could “not confirm with certainty” that the blow or blows were responsible for the victim’s brain hemorrhage. Was it the fall in the locker room? The level of alcoholization? Were they even pre-existing conditions?
The boys were found guilty of attempted grievous bodily harm: 15 months in prison, 14 of which were conditional. After the pre-trial detention, the port is outdated. The surviving relatives will each receive 200 euros.
