Partial prison sentence – abuse in the recovery room: Styria convicted

A 51-year-old Styrian allegedly sexually assaulted two defenseless patients in the recovery room of a private clinic in Graz. He protests his innocence. In one case he has now been sentenced – not legally binding – to two years’ partial imprisonment.

A nurse (51) went to court in Graz on charges of sexual harassment of two patients in the recovery room of a private clinic. The incidents are said to have occurred in 2015. The anesthetist is said to have taken advantage of the young woman’s defenseless condition.

Sexual fantasies, a known side effect
The defendant pleaded not guilty. “Sexual fantasies are a known side effect of the anesthetic propofol,” explains lawyer Julia Halm. An expert explained that such hallucinations caused by anesthesia can occur, but the evidence for this has not yet been clearly proven in the literature.

“Memories very detailed”
Now the verdict has been delivered: in one case the 51-year-old was acquitted by the chairman Julia Riffel, in the other case he was sentenced to 24 months’ partial imprisonment. “The victim’s memories are very detailed,” the judge explained. Julia Halm immediately filed an appeal. “I am convinced of his innocence.”
