The 76-year-old is believed to have had several opportunities to inappropriately touch and observe the girl several times during his wife’s absence between May 2017 and March 2022. He spied on the now 13-year-old in the bathroom and at the beginning of the incident, he also talked to the 7-year-old about intimate shaving. It is said to involve repetitive touching of the breast and vaginal area.
Responsibility as a supervisor
“Both grandparents took care of the child,” said Judge Norbert Hofer, meaning that the suspect was a trusted and, above all, supervisory person. At the beginning of this year, the man was sentenced to twelve months in prison during the case, nine of which were conditional. However, the Supreme Court (OGH) has partially annulled this.
Now the sentence was even higher: eighteen months (six necessary). Because the conviction for abuse of power was overturned, only this charge was heard. The conviction for sexual abuse of minors was already legally binding.
