So now: the Munich Regional Court has declared the climate protection group Last Generation criminal. The court justified its decision by stating that the purpose and activities of the association were aimed at committing crimes. It cited blockades of roads and airports as examples.
The court has declared ten complaints from climate activists against searches and seizures unfounded. The group now faces no further legal action. To be classified as criminal, crimes do not have to be the main purpose of the association. It is sufficient if they are assessed as one purpose among many.
In the last generation, coercion of road users, in particular trapping and damaging property, was classified as a criminal offense. According to the court, these actions pose a significant threat to public safety and are not minor crimes, such as an attempt to interrupt the flow of several oil pipelines.
Social discourse violated
The Munich Regional Court also concluded that social discourse was unlawfully violated when a group tried to place itself above the constitutional order and democratic processes – possibly in a morally superior way.
The Munich District Court issued several search and seizure warrants in May. In July, the Last Generation in Berlin was not classified as criminal after an investigation. In Austria, the Directorate of State Security and Intelligence (DSN) classified the climate protection group as “clearly not extremist” and “absolutely transparent.”
