The imposed sanction is not yet final, as Yelmo Cines has filed an appeal and the administrative procedure has not yet been completed, Kontsumobide explains.
The Basque Consumer Institute, Kontsumobidean autonomous body linked to the Ministry of Tourism, Trade and Consumption of the Basque Government, has imposed Helmet Cinemas a fine of 30,001 euros per prevent users from gaining access to your facilities with food purchased abroad.
In January, this organization started with one research following the complaints of eight people and the two complaints filed by two consumer associations: the Association of Basque People and Consumers and Users (EKA/ACUV) and Facua-Consumidores en Acción.
The imposed sanction is not yet final, as Yelmo Cines is a appealso the administrative process has not yet been completed, Kontsumoside explains.
In the lawsuit filed by EKA/ACUV It was reported that in cinemas Megapark and Artea de Bizkaia And Vitoria-Gasteiz Boulevard Since the beginning of this year, it has been prohibited to bring food and drinks purchased outside these establishments.
The organization understood that it was a “abusive practice” and requested the imposition of a fine of up to 150,000 euros, as it was a “serious consumer violation”.
“The main activity that Yelmo Films provides is showing films and It is not legal to ban outside food unless your main activity is catering. or that it be banned in general,” EKA/ACUV explained in a note on Monday.
The complaint of Facua also argues the same. The consumer association has denounced that the Yelmo chain has placed posters in its cinemas stating “the company does not provide access to these facilities with food and/or drinks purchased outside Yelmo and therefore reserves the right of access to us .” the same as on its website, something that according to Facua is contrary to the law: “The ambiguous service is not the essential defining activity of the cinema and therefore cannot exercise this right of access as if it were a restaurant.they claim.
Currently, this proceeding is still pending trial and its subsequent resolution.
Yelmo also has a cinema in Navarra, in the Itaroa de Huarte shopping center.
