Oberländer lived on state expenses, although he had rental income. After failing to declare these incomes to the AMS, the 59-year-old appeared before the Feldkirch Regional Court on Thursday.
This concerns approximately 12,350 euros in emergency aid, which the not so poverty-stricken man received within a year. After all, he owns two houses. He still has one on his lifetime annuity. His rental and lease income consists of five apartments.
The fact that he has to answer for serious fraud at the Feldkirch Regional Court does not seem to bother him. When Judge Silke Sandholzer wants to start the hearing, only his lawyer and the AMS clerk who was invited as a witness are present.
“Go here quickly now”
Mrs. Rat reached the defendant on the phone, but at her home. The man acts as if he has not received an invitation. Sandholzer, on the other hand, points out that the letter has been corrected. In order not to drag things out unnecessarily, Mrs. Rat Tacheles says: “Now listen carefully. You now have a hearing at the Feldkirch Regional Court. This is not an invitation, but a mandatory appointment. So come here quickly and it will be fine!” The process then starts an hour late.
The suspect shrugs off the accusations that he unlawfully received emergency aid. He admits to having submitted an application. He does not know whether it was unemployment or emergency aid. “I always got 900 euros,” claims the unskilled worker. When the judge asked why he had not declared the rental income, he said: “I didn’t know I had to declare it. I thought there wouldn’t be anything left.” Because he had high advertising costs for the objects. This means: property tax, operating costs and insurance.
Lawyer refers to special measures
Lawyer Michael Batlogg believes the recovery of 12,350 euros by the AMS is unjustified: ‘In the context of the Corona special measures, you did not have to declare rental income.’ Since the basis for calculating the emergency aid is the income tax assessment and this is not available, the process is postponed.
