Trial in Carinthia – Lego fraudster continues after dismissal

Date:

On Wednesday morning, a 26-year-old was sentenced to two years of unconditional imprisonment. Among other things, he had offered Lego sets on the internet and collected deposits, but only partially or not delivered them at all. The resulting damage amounts to 120,000 euros. The man had already been sentenced to an unconditional prison sentence for the same deception. The current ruling is not legally binding.

In 2019, he had already misled more than 250 customers from home and abroad through his Lego store. He sent orders incorrectly or not at all – he often sent sand instead of Lego. A total of 520,000 euros in damage was caused at the time. Two years later, the man was sentenced to three years in prison, one of which was unconditional.

Because he had already served a large part of his sentence in custody, he was released. However, the Graz High Court later revised the sentence upwards to three years. In the spring of 2022, shortly before he was jailed again due to the OLG decision, he started committing fraud again with the same scam.

The fraudster has confessed
The 26-year-old appeared contrite during questioning, nodding at each amount mentioned. “I was addicted to gambling and lost a lot of money. I want to do therapy,” he said, explaining why he had so quickly returned to the path of commercial fraud.

Lived a noble lifestyle
Prosecutor Denise Ebner explained that gambling addiction was a problem that the suspect needed to get under control quickly. But the crimes cannot be entirely attributed to this. The man led a lavish lifestyle with an income between 1,500 and 3,000 euros. 1,200 euros in rent, jewelery gifts and a holiday in Paris for his then partner, plus three cars rented at the same time, including a BMW M5 Competition of 4,800 euros per month alone: “I have no way to afford that, if I can even see that it’s worth it, it doesn’t work out.”
