A 54-year-old lawyer – the woman last worked as a real estate agent – had to appear at the Vienna Regional Court on Monday for continued persecution of her daughter and her sister, as well as several Chamber of Commerce officials. The starting point of the whole thing may have been a dispute about the will, in which the suspect got into an argument with her family.
After her company went bankrupt, the woman’s anger also focused on the Chamber of Commerce, which had abandoned her.
Lawyer insulted Commercial Council on Facebook
She addressed a commercial councilor via Facebook and WhatsApp with words that were both cordial and unpleasant. “These were attempts at contact as part of my conflict management,” the suspect said. She felt “helpless” at the time and “one or two insults were thrown at a late hour”: “But I didn’t insult him!”
The suspect allegedly demanded a commission
The defendant even demanded a commission from another official, whom she called, among other things, ‘Kanaille’, and supported her demand with blatant death threats. “The wording was inappropriate. I was offended. I probably overreacted.”
Judge: “These are phone calls”
She was completely unreasonable about her own family’s accusations. In this context, the public prosecutor was able to rely on the results of a call records request, which showed that the woman had committed real telephone terror against her relatives. “These are tirades of phone calls,” judge Martina Krainz accused the defendant. “You literally bombarded your daughter and her sister with phone calls.”
Defense denies the accusations
The lawyer denied this and stated that the intensity and duration of the conversations were not sufficient to constitute an unreasonable interference with the lifestyle. His client called ‘out of powerlessness, out of anger’.
The inheritance was reduced by half
In 2021, the defendant had to learn that her elderly mother had had her will changed. Her inheritance was halved because she did not provide enough care for her mother. Her sister would have largely taken over this. The will was allegedly changed mainly at the instigation of the defendant’s daughter, who “dragged her grandmother to the notary,” as the defendant claimed: “She (the testator, note) was surprised.”
Then she “wanted to talk” to her daughter and sister. She doesn’t remember exactly how many times or whether she hasn’t left them alone for two years: “I don’t remember exactly, that was so long ago.”
The hearing was adjourned because additional evidence needed to be gathered. A number of witnesses are expected at the next meeting in mid-February.
