Parents in custody – baby shaken to death: father denies violence

After the terrible death of a baby, who probably died in early February as a result of shaken baby trauma, the murder suspect father denies ever using violence against his children. The mother of the 26-year-old child remains silent, as does her lawyer.

The father of a child who died in Vienna in early February, probably as a result of a shaken baby trauma, cannot explain the boy’s death. His lawyer Astrid Wagner believes he is “innocent,” as she said on Wednesday after visiting the 29-year-old held in Josefstadt prison. The man and the 26-year-old mother are in custody and the Public Prosecution Service is investigating them both for murder.

“Breach of the hospital”
Although the mother and her lawyer Liane Hirschbrich have not yet commented on the suspicion, the father’s legal representative emphasized that he denied using violence against his children. In addition to the son, who died in the third month, there is a two-and-a-half-year-old daughter who now lives with crisis foster parents. “It also does not burden the mother,” Wagner emphasizes. The injuries that led to the child’s death are a mystery to her client: “He thinks something happened in the hospital during the rescue efforts.”

The 26-year-old mother went to the hospital with the baby on February 3 at 11 p.m. because there was a medical emergency. “There have been problems with the child in the past. It was noticeable, he was a tight kid,” Wagner said. The parents therefore repeatedly sought medical help.

The hospital alerted the police
But on February 3, all help came too late for the little boy. At the time of his hospitalization, he likely had no brain function due to injuries that were not visible from the outside. Three days later, life support machines were turned off and the boy was pronounced dead.

The hospital then alerted the police after an MRI scan showed brain damage that usually indicates a so-called shaken baby trauma. The small body also had a broken arm and a broken rib.

The written autopsy report requested by the public prosecutor to provide clarity about the exact cause of death is not yet available. The next regular detention screening date for the parents is the end of March.
